Points-based driving licence for working on construction sites arrives
The government has introduced a new ‘points licence’ system to increase safety on temporary or mobile construction sites. The measure, announced by the Ministry of Labour last week in response to the tragic death of five workers in the collapse of a building site for the construction of an Esselunga supermarket, was included in the draft Pnrr-bis decree discussed in the Council of Ministers yesterday. According to art. 27 of the draft decree, the system should come into effect on 1 October 2024, once the National Submerged Work Portal has been implemented with a dedicated section. Companies and self-employed workers operating at temporary or mobile construction sites will be required to possess the licence.
The points licence on construction sites and the SOA
This system, designed for companies and self-employed workers, is based on a score that decreases in the event of non-compliance. Starting with 30 points, violations can lead to a reduction in points of up to 20 points for the most serious incidents, such as the death of a worker. The aim is to prevent entities with less than 15 points from operating on construction sites, thus promoting a safer working environment.
However, there is an important exception: those who carry out mere supplies or services of an intellectual nature are not obliged to possess the points licence; companies in possession of the SOA certificate of qualification, in classification III or higher, are not obliged to possess the points licence.
The SOA certificate is a certification that qualifies companies to participate in tenders for public works exceeding €150,000, attesting to their economic-financial capacity and technical requirements.
